Abstract
Politična participacija državljanov je temelj demokratičnosti. Glede na to, da se dandanes cel svet spopada z velikim upadom politične participacije državljanov, je smiseln razmislek, ali je z namenom zagotavljanja demokratičnosti sistema ter legitimnosti izvoljene oblasti upravičeno v političnem sistemu uveljaviti institut obvezne volilne udeležbe. Institut obvezne volilne udeležbe od državljanov namreč zahteva politično participacijo na volitvah, kar zagotavlja dobro zastopanost v parlamentu in sprejemanje odločitev, ki so v skladu z volilnim elektoratom. Na drugi strani se postavlja vprašanje, ali je institut obvezne volilne udeležbe demokratičen instrument za zviševanje volilne udeležbe na volitvah. Če je volilna pravica pravica, ali je zato upravičljivo, da država od državljana zahteva implementacijo pravice? Upravičenost je torej odvisna od posameznikovega razumevanja volilne pravice kot pravice v nasprotju z dolžnostjo in razmerja med svobodo ter visoko volilno udeležbo. Magistrsko delo na primeru dveh skupin držav (držav s trenutno uveljavljenim ter držav z ukinjenim institutom obvezne volilne udeležbe) razkriva, ali je institut obvezne volilne udeležbe upravičen instrument zviševanje volilne udeležbe v demokratičnemu sistemu.

Title:The legitimacy of compulsory voting from the perspective of the democratic system
Abstract:
Political participation is foundation of the democracy. Considering that nowadays the whole world is dealing with a great decline in political participation, it makes sense to consider whether, in order to ensure the democracy and the legitimacy of the elected government, it is justified to implement compulsory voting in the country's political system. The Institute requires citizens to participate in elections, which ensures good representation in the Parliament and reflects voter preferences. The question of whether compulsory voting is justifiable for increased voter participation in elections is a matter of debate. If the right to vote is a right, is it justifiable for the state to demand the implementation of the right from its citizen? Whether compulsory voting is justifiable depends on the individual understanding of voting as a right versus duty and the balance between benefits of individual freedom and high voter turnout. The master's thesis reveals on the case of two groups (countries with the currently established and countries with abolished compulsory voting) whether compulsory voting is a legitimate instrument for increasing voting turnout in a democratic system.
