Abstract
To magistrsko diplomsko delo obravnava disocialne storilce nasilnih kaznivih dejanj, bolj znane kot (nasilne) psihopatske storilce, ki se nahajajo na stičišču duševnih motenj, osebnostne patologije in kriminalnega vedenja. Glavni poudarek raziskave se osredotoča na oblikovanje ustreznih strategij kaznovanja za to neproporcionalno zastopano podskupino v zavodih za prestajanje kazni. Raziskava uporablja celovit pristop, ki združuje teoretične in empirične razsežnosti ter razmejuje terminološke in semantične posebnosti, klinične klasifikacije in kriminološke stališča v zvezi s to osebnostno motnjo. Poleg tega se ukvarja z zapletenim vprašanjem kazenske odgovornosti posameznikov z disocialnimi lastnostmi, pri čemer se spoprijema z nejasnostmi, ki so neločljivo povezane z njihovim stanjem. Delo zagovarja uravnotežen pristop, ki se na eni strani zavzema za ohranitev njihove kazenske odgovornosti, na drugi strani pa se zavzema za prilagojene kaznovalne strategije, ki obravnavajo njihove specifične izzive. Na koncu magistrsko delo poudarja kompleksnost tematike in izpostavlja nujnost dobro premišljenih domačih odločitev in interdisciplinarnih dialogov za učinkovito obravnavo njihovega posebnega položaja v kazenskopravnem sistemu.

Title:Sentencing dissocial violent offenders
Abstract:
This master's thesis discusses dissocial offenders of violent crimes, more commonly known as (violent) psychopathic offenders, who are at the junction of mental disorders, personality pathology and criminal behaviour. The main focus of the study is on the formulation of appropriate sentencing strategies for this disproportionately represented subgroup in penal institutions. The research uses a holistic approach that combines theoretical and empirical perspectives and delineates the terminological and semantic specificities, clinical classifications and criminological viewpoints regarding this personality disorder. Furthermore, it addresses the complex issue of the criminal responsibility of individuals with dissocial traits, confronting the ambiguities that are inherent in their condition. Thesis argues for a balanced approach that, on the one hand, advocates for the maintenance of their criminal responsibility and, on the other hand, advocates for tailored sentencing strategies that address their specific challenges. Finally, the thesis underlines the complexity of the topic and highlights the need for well-considered domestic decisions and interdisciplinary dialogues to effectively address their specific situation in the criminal legal system.
