Abstract
Magistrsko diplomsko delo z naslovom Priznanje in izvršitev mednarodnih poravnav se začne z orisom evropske ter slovenske zakonodaje, ki zadeva priznanja in izvršitve sodnih poravnav v mednarodnem zasebnem pravu v civilnih in gospodarskih zadevah. Nadalje je v magistrskem diplomskem delu predstavljena primerjalno pravna ureditev postopkov priznanja in izvršitve sodnih poravnav v Uredbah Bruselj I, Uredba Bruselj I bis ter v t. i. uredbah EU tretje generacije, Uredbi o uvedbi evropskega naloga za izvršbo nespornih zahtevkov, Uredbi o uvedbi postopka za evropski plačilni nalog in Uredbi o uvedbi evropskega postopka v sporih majhne vrednosti. V drugem delu magistrskega diplomskega dela so uvodoma predstavljene možnosti za čezmejno izvršitev izvensodnih poravnav. Poudarek drugega dela magistrskega diplomskega dela je na postopku priznanja in izvršitve mednarodnih poravnav, doseženih v postopkih gospodarske mediacije v okviru Singapurske konvencije, pri čemer je konvencija na posameznih mestih primerjana z Newyorško konvencijo o priznanju in izvršitvi tujih arbitražnih odločb. V sklepnem delu magistrskega diplomskega dela je poudarjena razlika med naprednostjo EU ureditve postopkov priznanja in izvršitve sodnih poravnav ter na drugi strani odsotnostjo mednarodno pravnega urejanja postopkov priznanja in izvršitve izvensodnih poravnav. Čezmejno priznanje in izvršitev izvensodno doseženih poravnav urejajo le Uredba o uvedbi evropskega postopka v sporih majhne vrednosti in Uredba o uvedbi postopka za evropski plačilni nalog ter na mednarodni ravni Singapurska konvencija. Singapurska konvencija predstavlja velik korak k unifikaciji sistema priznanja in izvršitve mednarodnih poravnav, vendar pa s strani držav EU še ni doživela nobene ratifikacije.

Title:
Recognition and enforcement of international settlements
Abstract:
This Master’s thesis with the title Recognition and enforcement of international settlements examines the European and Slovenian legislation concerning the recognition and enforcement of court settlements in private international law in civil and commercial matters. It also presents the comparative legal regulation of the procedures for recognizing and enforcing court settlements in the Brussels I Regulation, the Brussels I bis Regulation, and in third-generation EU regulations, i.e., the European enforcement order for uncontested claims regulation, the European order for payment procedure regulation, and the European small claims procedure regulation. The second part of this Master’s thesis focuses on the possibilities for cross-border enforcement of out-of-court settlements. Specifically, the second part of this thesis examines the procedure for recognizing and enforcing international settlements achieved through commercial mediation processes under the Singapore Convention. A comparison is drawn between the Singapore Convention and the New York Convention on the recognition and enforcement of foreign arbitral awards. The final section of the Master’s thesis highlights the disparity between the progressive EU regulation of the procedures for recognizing and enforcing court settlements and the absence of international legal regulation of the procedures for recognizing and enforcing out-of-court settlements. Currently, the cross-border recognition and enforcement of out-of-court settlements is primarily governed only by the European small claims procedure regulation and the European order for payment procedure regulation, and, at the international level, by the Singapore Convention. While the Singapore Convention represents a significant advancement towards unifying the system of recognizing and enforcing international settlements, it has yet to be ratified by EU countries.
