Abstract
Magistrsko delo obravnava pravni položaj samozaposlenih oseb. Najprej opredeli splošne pojme, katerih razmejitev je pomembna za določitev kroga oseb, ki jim je zagotovljeno delovnopravno varstvo. Predvsem je pomembna opredelitev delovnega razmerja, saj je od definicije le-tega odvisno priznanje statusa delavca. V nadaljevanju magistrsko delo ponazori razlike v varstvu in pravicah, ki so jih deležne osebe v delovnem razmerju ter samozaposlene osebe. Razlike se pojavljajo tako v delovnopravni zakonodaji kakor tudi socialnopravni zakonodaji. Za obe skupini lahko najdemo tako pozitivne kot negativne aspekte. Vsekakor pa je pri samozaposlenih osebah varstvo manjše. Magistrsko delo nadalje povzame tri ravni varstva, tj. zakonodajno, inšpekcijsko in sodno. Predstavljeno so dodatni možni ukrepi, ki bi lahko izboljšali položaj (navidezno) samozaposlenih oseb. Ukrepi izvirajo tako iz idej, ki jih podaja teorija, kakor iz primerjalnopravnih zgledov. V zaključku magistrsko delo predstavi zanimiva vprašanja ugotavljanja delovnega razmerja za navidezno samozaposlene osebe, ki so se pojavila v sodni praksi. Navidezna samozaposlenost ni nov pojav na trgu dela. Na problematiko že več let opozarjata tako slovenska kot mednarodna stroka ter mednarodne organizacije. Mogoče je zaznati, da se položaj navidezno samozaposlenih oseb izboljšuje, vendar prepočasi. Slovenski zakonodajalec lahko veliko idej za nove ukrepe najde v primerjalnopravni analizi. Skozi analizo sodne prakse je moč ugotoviti, da so sodišča naklonjena varstvu samozaposlenih oseb. V skladu s tem zagovarjam stališče, da je bila trenutna ureditev možnosti ugotovitve delovnega razmerja do sedaj zadostna. Vsekakor pa je v zakonodajah drugih držav članic prisotni še veliko ukrepov, ki bi jih slovenski zakonodajalec moral vključiti v sistem in tako zagotoviti boljše (preventivno) pravno varnost.

Title:Bogus self-employment
Abstract:
The master's thesis discusses the legal position of self-employed persons. First, it defines the general terms, defining of which is important for determining the circle of persons protected by labor law. The definition of the employment relationship is important, as the recognition of the status of an employee depends on its definition. In the continuation of the master's thesis, illustrates the differences in protection and rights enjoyed by persons in an employment relationship and a self-employed person. Differences occur both in labor and social legislation. Both positive and negative aspects can be found for both groups. However, the protection is less strong for self-employed persons. The master's thesis further summarizes the three levels of protection, i.e. legislative, inspection and judicial. It presents additional possible measures that could improve the situation of (bogus) self-employed persons. The measures originate both from the ideas given by the theory and from comparative legal perspectives. In the conclusion of the master's thesis, interesting questions of determining the employment relationship for apparently self-employed persons, which have appeared in judicial practice, are presents. Bogus self-employment is not a new phenomenon in the labor market. Both Slovenian and international theory and international organizations have been drawing attention to the problem for several years. It is possible to asses that the situation of bogus self-employed persons is improving however, too slowly. The Slovenian legislator can find many ideas for new measures in a comparative legal analysis. Through the analysis of judicial practice, it can be established that the courts do favour the protection of self-employed persons. Accordingly, I defend the view that the current regulation which provides for the possibility of establishing an employment relationship thru courts, has so far been sufficient. Notwithstanding, there are still many measures in the legislation of other member states that the Slovenian legislator should include in the system and thus ensure better (preventive) legal security.
