The main purpose of the diploma thesis is to systematically present the entire procedure of exchanging a foreign driving license for a driving license from the Republic of Slovenia, for which the administrative unit is the competent authority. In doing so, I wanted to lay the foundations or basic instructions for exchanging a foreign driving licence for a Slovenian one, which will be of help to the client, the official or the random individual interested in the future in this area. The reason for choosing my diploma thesis topic was my desire to explain and analyse the procedure more consistently since, as an employee of an administrative unit, I am faced with daily management and decision-making in exchange foreign driving license. Unfortunately, not much had been written on the subject during my research time.
The objectives of the diploma thesis were achieved based on secondary research. In the comparative analysis of the procedure of exchanging a foreign driving license for a Slovenian one, I examined the empirical part, using statistical data on the number of procedures by selecting the administrative unit, a questionnaire, and my findings, two hypothetical questions concerning the uniform proof of the fact of habitual residence by the administrative unit and the countries that issued the foreign driving license. The research results showed that, in practice, the administrative units uniformly prove the fact of habitual residence. Still, at the same time, similar procedural difficulties are encountered, concerning the loose scope of the fact of habitual residence and its proof in the countries of the former Yugoslavia, where it is often difficult for a party to provide a solid, tangible burden of evidence based on which we establish the integrity of the circumstances surrounding the fact of habitual residence. In the 2016-2021 survey period, there has been a significant decline in the procedure since 2017, with most exchanges of foreign driving licenses for Slovenian ones taking place in the case of foreign driving licenses issued in the Balkans, mainly in Bosnia and Herzegovina and Kosovo.
In my opinion, the fact of habitual residence should be legislated in a more prescriptive manner - perhaps by defining specific (necessary) proofs in different cases of groups of countries in the process of exchanging a foreign driving license for a Slovenian one (Balkan countries, EU Member States and other countries), which would facilitate the work of the administrative unit officials, create some background for them, and at the same time prevent anomalies in the proof procedure.
