Human dignity is the foundation of a democratic and legal state. Under its protection, the constitutional right to honor and reputation is also asserted, which is often opposed by the constitutional right to freedom of speech. The conflict between these two rights is resolved by the Criminal Code (KZ-1), which in its eighteenth chapter prescribes crimes against honor and reputation.
The structure of my master thesis is designed in such a way, that the constitutional starting points for the protection of honor and reputation are introduced, followed by an analysis of each individual criminal act against honor and reputation, which is supported by the relevant case law of the Constitutional, Supreme and Higher Courts of the Republic of Slovenia.
