Upravni postopek priključitve na plinovodno omrežje v Sloveniji

Abstract
Z vstopom v Evropsko unijo je v slovenskem pravnem redu pričela veljati Uredba o zmanjšanju emisij toplogrednih plinov. Začetek veljavnosti Uredbe pomeni zagotavljanje čistejšega zraka in boljšega okolja, ki je pomemben tudi za prihodnost. Z Energetskim zakonom (EZ-1) so v slovenski zakonodaji določena načela, pravila, načini in oblike, ukrepi, pogoji, pristojnosti, organizacija ter delovanje na področju energetske politike. Z uporabo zemeljskega plina lahko preprečimo izpuste toplogrednih plinov, ki so za okolje in zdravje prebivalstva zelo škodljivi. Nekateri posamezniki se zaradi tega zavestno odločijo za spremembo energenta, ki ga uporabljajo za ogrevalne in druge namene. Energetski zakon poleg pravil priključitve na plinovodno omrežje določa tudi, da mora priključitev biti izpeljana v skladu z Zakonom o splošnem upravnem postopku (ZUP). V diplomski nalogi je predstavljen zemeljski plin, Agencija za energijo in podjetje Adriaplin d. o. o., ki deluje kot distributer zemeljskega plina. Kot osrednji problem je izpostavljen upravni postopek priključitve na plinovodno omrežje ter na praktičen in lahek način so bodočim odjemalcem predstavljene vse štiri faze upravnega postopka. Poleg tega so analizirane odločbe, ki jih objavlja Agencija za energijo in ugotovljeni so najpogostejši vzroki za uporabo pravnih sredstev v upravnem postopku. V okviru analize je bilo ugotovljeno, da prebivalstvo slabo pozna postopek priključitve na plinovodno omrežje in da so pravna sredstva največkrat uporabljena zaradi kršenja pravic strank in bistvenih kršitev postopka.

Title:Administrative procedure to hook on the gas pipe network in Slovenia
Abstract:
With our entrance into the European Union, the Regulation on the Reduction of greenhouse gas emissions entered into force in the Slovenian legal order. The entry of the Regulation means ensuring cleaner air and a better environment, which is also important for the future. The Energy Act defines the principles, rules, methods and forms, measures, conditions, competencies, organization and operation in the field of energy policy in Slovenian legislation. By using natural gas, we can prevent greenhouse gas emissions, which is very harmful to the environment and the health of the population. Because of this, some individuals consciously decide to change the energy source they use for heating and other purposes. In addition to the rules for connection to the gas network, the Energy Act also stipulates that the connection must be carried out in accordance with the Act on General Administrative Procedure. In the diploma thesis we will present natural gas, the Energy Agency and the company Adriaplin d. o. o., which acts as a distributor of natural gas. As a central problem, we will highlight the administrative procedure of connection to the gas network and present all four phases of the administrative procedure to future customers in a practical and easy way. In addition, we will analyze the decisions published by the Energy Agency and determine the most common reasons for the use of legal remedies in administrative proceedings. The analysis found that the population has a poor understanding of the process of connecting to the gas network and that the most common remedies are for violation of the rights of the parties and fundamental procedural violations.
