Abstract
Presumpcija ali pravna domneva je v sodobnih pravnih sistemih nepogrešljiv institut, saj pripomore k učinkovitosti in hitrosti pravnih postopkov. Presumpcija na podlagi določenih znanih dejstev šteje neko neznano dejstvo za resnično in s tem ustvarja pravne učinke, ki veljajo pod razveznim pogojem. Pravno domnevo je namreč z dokazom njene neresničnosti mogoče izpodbiti in s tem izničiti njene posledice. Korenine presumpcije segajo v staro Grčijo, kjer je njene temelje postavil Aristotel z razlago retoričnega silogizema. Njegovo zamisel so prevzeli stari Rimljani, ki so dokočno oblikovali institut presumpcije. Za silogistični sklep, to je za sklepanje na podlagi življenskih izkušenj iz znanih dejstev na neznana, so pravniki sprejeli poimenovanje praesumptio facti ali praesumptio hominis, ki je podlaga za poznejši institut presumpcije, imenovan praesumptio iuris. Na osnovi presumpcije je nastal še njej soroden institut, in sicer neizpodbojna domneva ali praesumptio iuris et de iure. Presumpcije so vsebovane v zakonodaji, v sistemu common law pa so lahko obvezujoče tudi prek precedenčnih sodb. V nalogi je institut presumpcije poglobljeno analiziran, opisan je njegov razvoj skozi zgodovino in podrobneje so predstavljene nekatere konkretne presumpcije, tako sodobne kot zgodovinske.

Title:Roman law institute of presumption and its influence on modern law
Abstract:
Presumption is indispensable in modern legal systems due to its efficiency as well as the speed it brings to legal proceedings. Its purpose is to assume an unknown fact to be true based on certain known facts and thus to make legal effects which are valid under resolutory condition. Presumption can actually be rebutted during proving process and thus nullify its efectiveness. The roots of presumption go back to ancient Greece, when Aristotle laid its foundations with his concept of rhetorical syllogism. His idea was taken up by ancient Romans who finalized the institute of presumption. For a syllogistic conclusion, which means a conclusion based on life experience from known facts to unknown ones, lawyers adopted the name praesumptio facti or hominis, which is the basis for the later institute of presumption, called praesumptio iuris, and the irrefutable presumption derived from it, known as praesumptio iuris et de iure. Presumptions are contained in positive legislation, in the common law system they can also be binding through precedent rulings. In the assignment, the institute of presumption is thoroughly analyzed, its development throughout history is described, and some specific presumptions, both modern and historical, are presented in more detail.
