The master's thesis entitled "Procedure for guardianship for adult in case law" outlines the course of non-litigious procedure for placing an adult under guardianship with emphasis on the views of current case law. Brief overview of the past legislation and reasons for changing it, is followed by the purpose of guardianship for adults and some principles which must be taken into account when deciding on this measure, in particular the principle of proportionality. Possible ways of initiating procedures and jurisdiction are presented with emphasis on cases from the practice when the Supreme Court of the Republic of Slovenia (hereinafter: VSRS) decided on the delegation of jurisdiction. The position of the statutory participants in the procedure is described, namely the position of the temporary guardian and the centre for social work (hereinafter: CSD) and the nature of the opinions given by CSD in the procedure. Mandatory hearing and duty to be examined by a medical expert is presented through case law as a special feature of this type of procedure. In the process of appointing a guardian, the emphasis is on the practice of the courts regarding the issue of the suitability of the guardian and the potential conflict of interest between him and the client. Some of the decisions of the courts regarding the possibility for a person placed under guardianship to express wishes regarding who should be appointed to him as a guardian, which gives that person a certain degree of autonomy are highlighted. The master's thesis also presents potential changes in the scope of the guardian's obligations and rights and the termination of guardianship followed by summaries of court decisions in the area of distribution of costs of proceedings and clarifications regarding the court's duty to inform the land register and other registers on the initiation of proceedings and other information on guardianship for adults. I am concluding my master's thesis by stating the legal remedies available to participants in this type of procedure.
