Abstract
Diplomsko delo se v svojem teoretičnem delu osredotoča na pravico do odklopa kot sodobnemu ukrepu na področju delovnega življenja. Vzroke za pomembnost te pravice opišem na področjih digitalizacije, opredelitve delovnega časa in opravljanja dela od doma. Kot možne načine preprečevanja opravljanja delovnih nalog izven delovnega časa predstavim francosko uzakonitev pravice do odklopa in nemški sistem samoregulacije podjetij. V nadaljevanju podrobneje predstavim pomembnost pravice do odklopa z vidika usklajevanja delovnega in zasebnega življenja. Omenim težave, ki se pojavijo ob konfliktu med delovnim in zasebnim življenjem, ter skupine delavcev, ki imajo običajno pri tem največ težav oz. so iz raziskovanja področja usklajevanja pogosto izključene (npr. delavci brez otrok). Med ukrepi s področja usklajevanja delovnega in zasebnega življenja izpostavim certifikat Družini prijazno podjetje. Z raziskavo želim odgovoriti na raziskovalna vprašanja o poznavanju pojma pravice do odklopa med delavci in o njihovem stališču glede vprašanja o pogostosti dela izven delovnega časa in vprašanja o izzivih in težavah pri usklajevanju delovnega ter zasebnega življenja. Poleg tega me zanima, kaj naj bi pravica do odklopa po mnenju delavcev sploh obsegala in kakšne posledice bi na njihovo usklajevanje prinesla njena uvedba ter možne negativne vidike uvedbe ukrepa. S kvalitativno raziskavo in neslučajnostnim priložnostnim vzorcem 7 delavcev sem prišla do glavnih ugotovitev, da je pojem pravice do odklopa med delavci večinoma nepoznan, a kljub temu se strinjajo, da bi njena uveljavitev pozitivno vplivala na zahtevnost usklajevanja delovnega in zasebnega življenja. Izbrani delavci redko opravljajo delo izven delovnega časa, za večino pa je usklajevanje delovnega in zasebnega življenja nezahtevno. Med možnimi oblikami pravice do odklopa delavci vidijo popolno prepoved kontaktiranja izven delovnega časa ali določitev ure, po kateri kontaktiranje ni več mogoče, ali pa jasno določitev izjem za kontaktiranje. Kot pozitivne posledice potencialne uvedbe pravice do odklopa omenjajo še zmanjšanje stresa ali povečanje produktivnosti in več časa za družino.

Title:The Right to Disconnect for Better Work-Life Balance
Abstract:
The theoretical part of the thesis focuses on the right to disconnect as a modern measure in the field of working life. I describe the reasons for the importance of this right from the fields of digitalization, defining of the working hours and performing of work from home. As possible ways of preventing work performance outside of working hours, I present the French enactment of the right to disconnect and the German system of company self-regulation. In continuation, I thoroughly present the importance of the right to disconnect from the view of work-life balance. I mention the problems, which arise at the conflict of work and private life, and groups of workers, who usually have the most problems or are excluded from the research of the field of work-life balance (e.g. workers without children). Among the measures from the field of work-life balance, I stress out the Family Friendly Enterprise Certificate. With the research, I want to answer the research questions on the awareness of workers about the right to disconnect and about their attitude towards the question of the frequency of working outside of working hours and about challenges and problems connected to work-life balance. In addition, I want to know what the right to disconnect includes according to workers and what consequences its enforcement would bring in terms of work-life balance, and what are the negative aspects of the implementation of the measure. With a qualitative analysis and non-randomized ad-hoc sample of 7 workers, I came to the main conclusions that workers are mostly not familiar with the term right to disconnect, however, they agree that its enforcement would have a positive impact on the complexity of work-life balance. The chosen workers rarely perform their work after working hours and the majority of them find balancing of work and private life not demanding. Among the possible forms of the right to disconnect, some workers see the absolute prohibition of contact outside of working hours or the setting of an hour, after which contact would be impossible, or a strict setting of exceptions for contact initiation. As positive consequences of the potential implementation of the right to disconnect, they also mention stress reduction, increase of productivity and more time for the family.
