POGODBA O PRIVEZU ČOLNA

Obravnavana tema diplomske naloge se navezuje na pogodbo o privezu čolna. Pri tem v nalogi raziskujemo uporabo te pogodbe v Sloveniji, kateri so njeni bistveni sestavni deli, kdo sklepa pogodbo, kdo jo sestavlja, kakšne obveznosti in dolžnosti imajo upravljavci pristanišč in njihovi uporabniki na podlagi pogodbe. V diplomski nalogi ugotavljamo, ali bi lahko bila pogodba o privezu čolna sprejeta v Pomorski zakonik. Primerjavo iščemo v nedavno posodobljenem hrvaškem Pomorskem zakoniku, ki že vsebuje pogodbo o privezu čolna v poglavju, ki se imenuje »Ugovor o navtičkom vezu« (slov. Pogodba o navtičnem privezu) in tako pokriva bistvena pravna vprašanja, ki se navezujejo na pogodbo o privezu.

Abstract

The topic of this diploma thesis is related to the boat mooring contract. Related to this, the working paper investigates the broad usage of a boat mooring contract in Slovenia, its essential components, both parties of the contract and their obligations to the contract, and who composes the contract. In this thesis we determine whether the contract on the mooring boat could be accepted or should be accepted into the Slovenian Maritime Code. For, this we are looking for encouragement in the recently updated Croatian Maritime Code, which has accepted the boat contract into the Maritime Code and thus created a new chapter, otherwise called the »Nautical Mooring Agreement«, thus provided some essential answers and covered legal issues related to the mooring contract in Croatian Maritime code.
