Abstract
Diskriminacija, ki je v naši družbi še vedno prisotna na vseh področjih našega življenja, pomeni neenako obravnavanje določene osebe ali skupine oseb na podlagi njene oziroma njihove osebne okoliščine. Zagotavljanje varstva pred diskriminacijo je obsežno urejeno tako na mednarodni ravni, v pravu EU kot tudi na nacionalni ravni. Prednostno obravnavanje oziroma pozitivna diskriminacija, predstavlja enega izmed ukrepov prava varstva pred diskriminacijo. Pri prednostnem obravnavanju gre za ukrepe, s katerimi označujemo prednostno obravnavo določene skupine oseb pri uresničevanju pravic, ki so načeloma pod enakimi pogoji zagotovljene vsem. V slovenski zakonodaji se prednostno obravnavanje oziroma pozitivno diskriminacijo označuje z izrazom posebni ukrepi, ki se nato delijo na spodbujevalne in pozitivne ukrepe. V skladu s slovensko zakonodajo morajo takšni ukrepi zasledovati legitimen cilj odprave manj ugodnega položaja oseb z določeno osebno okoliščino, utemeljeni morajo biti na ustreznih analizah oziroma ugotovitvah manj ugodnega položaja oseb z določeno osebno okoliščino ter predstavljati potrebno in ustrezno sredstvo za odpravo takšnega položaja. Poudarek v nalogi namenjam analizi instituta prednostnega obravnavanja v Sloveniji. Poleg pravne podlage v evropski in slovenski zakonodaji ter praksi Ustavnega sodišča RS, v drugem delu z analizo ukrepov, ki jih izvajajo ministrstva, prikažem tudi dejansko stanje uporabe in učinkovitosti instituta prednostnega obravnavanja v slovenskem protidiskriminacijskem pravu.

Title:Special measures for ensuring equality in anti-discrimination law
Abstract:
Discrimination is still present in our society in many areas of our lives. It means unequal treatment of a certain person or group of people based on their particular personal grounds. Anti-discrimination law is adopted in international anti-discrimination legislation, in EU law as well as at the national legislation. Special measures sometimes described as positive discrimination are part of anti-discrimination law. They indicate the priority treatment aimed at the improvement of the position of a group of persons with a particular personal ground to ensure the realisation of the right to equal treatment and equal opportunity. In Slovenian legislation, there are two types of special measures, incentive special measures and positive action measures. Such measures shall pursue a legitimate objective of eliminating less favourable positions of people in certain personal circumstances based on analyses of the existence of a less favourable position, and which are necessary and appropriate means of eliminating such a position. The thesis focuses on the analysis of special measures in Slovenia. In addition to the legal basis in European and Slovenian legislation and the practice of the Constitutional Court RS, I analyse the measures adopted by ministries and find out the actual use and effectiveness of the institute of special measures in Slovenian anti-discrimination law.
