Abstract
Gradbena pogodba predstavlja eno izmed najbolj kompleksnih obligacijskopravnih razmerij. Je razmerje, ki traja razmeroma daljše časovno obdobje. Obsežna časovna komponenta pomeni tudi večjo verjetnost, da bo med trajanjem pogodbenega razmerja prišlo do takšnih in drugačnih okoliščin, ki bi lahko otežile izvedbo pogodbeno dogovorjenega dela, to je izvedbo gradnje oziroma drugih gradbenih del. Da sta stranki čim bolj pripravljeni na različne okoliščine, ki ju lahko doletijo, mora biti temu primerno napisana tudi sama gradbena pogodba. V slovenskem pravnem prostoru lahko stranki pogodbo sestavita sami, skladno z določbami Obligacijskega zakonika. Lahko pa se poslužita splošnih pogodbenih pogojev po knjigah FIDIC, pri čemer je izbira knjige FIDIC odvisna od narave konkretnega razmerja in vrste del, ki jih naročnik prepušča izvajalcu. Obligacijski zakonik in knjige FIDIC gradbeno pogodbo urejata različno. Magistrsko diplomsko delo predstavlja ureditev po obeh, s poudarkom na spremembi predmeta pogodbe, do katerega lahko pride zaradi različnih okoliščin in potreb, ki nastanejo med časom trajanja pogodbenega razmerja med strankama. Prikazuje, da se je v praksi izoblikovala potreba po natančnejši ureditvi gradbene pogodbe, ki presega okvirje, kot so postavljeni v Obligacijskem zakoniku. Magistrsko diplomsko delo prikazuje tudi, katere elemente iz knjig FIDIC bi slovenski zakonodajalec lahko vključil v del Obligacijskega zakonika, ki ureja gradbeno pogodbo.

Title:Variations of a construction contract under the Slovenian Civil Code and FIDIC
Abstract:
The construction contract is one of the most complex contractual relationships. It is a legal relationship, which lasts for a relatively long period of time. The latter means also a greater probability that different circumstances could arise, which could potentially make it harder for the contractually agreed work to be carried out during the duration of the parties' contractual relationship. In order for the parties to be as prepared as possible in the event of such circumstances, the contract has to be drafted accordingly. In the Slovenian legal system, the parties can write a construction contract themselves, according to the Slovenian Civil Code. Or, they could use the general conditions included in one of the FIDIC Books of Contracts, the colour of which is dependent on the nature of the contractual relationship and the type of work the employer hands over to the contractor. The Slovenian Civil Code and the FIDIC Books of Contracts regulate the construction contract differently. The Master's Thesis presents and discusses both regulations, with an emphasis on contract variations, which arise from different circumstances and needs, which appear during the duration of the contractual relationship between the parties. The Master's Thesis demonstrates that there is a need in practice for the construction contract to be regulated with more precision than there currently is within the Slovenian Civil Code. The Master's Thesis shows which elements from the FIDIC Books of Contracts could the Slovenian legislator include in the construction contract part of the Slovenian Civil Code.
