Pogodba o gradbenem inženiringu

Področje gradbeništva v zadnjih letih doživlja hiter razvoj, kateremu pa ne sledi gradbena zakonodaja. Zaradi tega so se v praksi izoblikovali avtonomni tipi pogodb, ki urejajo nove oblike gradnje na svojevrsten način. V magistrski nalogi je prikazano, na kakšen način bi lahko na podlagi obstoječega prava in prakse uzakonili nov tip pogodbe – pogodbo o gradbenem inženiringu. Hipotezi postavljeni na začetku magistrske naloge, da je mogoča uzakonitev novega tipa pogodbe, pritrjujem s tem, ko predstavim obstoječe pogodbe, ki urejajo razmerja med udeleženci v gradnji, prakso v tujini, ki takšne pogodbe že pozna in nazadnje določila, ki naj bi jih vsebovala pogodba o gradbenem inženiringu. S to pogodbo se tako pod eno streho združijo vse storitve, potrebne za dosego končnega cilja naročnika, ki je izgradnja objekta.

Abstract

The field of construction has been experiencing rapid development in recent years, which is not followed by construction legislation. As a result, in practice, autonomous types of contracts have been formed, which regulate new forms of construction in a unique way. This master's thesis shows how a new type of contract could be legalized on the basis of existing law and practice - Construction engineering contract. I agree with the hypothesis set at the beginning of this master's thesis that it is possible to legalize a new type of contract, by presenting the existing contracts governing the relations between the participants in construction, practice abroad, which already knows such contracts and finally presenting provisions that construction engineering contract should contain. With this contract, all services necessary to achieve the final goal of the investor, which is the construction of a building, are combined under one roof.
