Abstract
Neoliberalizem je v Ameriki povzročil krizo vladanja in omogočil vzpon kaznovalne države. V Ameriki je socialna država odpravljena, v Evropi pa dopolnjena s policijo, sodišči in zapori. Posledica neoliberalizma je množično zapiranje, s katerim vladajoče elite kazenski sistem uporabljajo kot instrument obvladovanja socialne negotovosti. Amerika je z doktrino ničelne tolerance razglasila »vojno proti drogam« in s tem upravičila policijsko in sodno upravljanje moteče revščine. Tudi Evropa je po razglasitvi »vojne proti drogam« začela boj proti odvečnim delom prebivalstva, ki so smatrani za manj koristne in nevarne družbi kot celoti. Vzpon zasebne industrije zapiranja je le še okrepil množično inkarceracijo. Moderna funkcija zapora tj. rehabilitacija in resocializacija je že dolgo potisnjena v ozadje, saj zapori, prenapolnjeni predvsem z Afroameričani in evropskimi »tujci«, ne morejo uresničevati teh ciljev. Zapor je v današnjem času postal odlagališče družbi nevarnih posameznikov.

Title:Comparison of American and European penal policy
Abstract:
Neoliberalism has started a crisis of government in the USA and it allowed the rise of criminal state. In the USA the social state was dismissed, in Europe it was completed with the police, courts and prisons. The consequence of neoliberalism is mass lock down, with which the ruling elite uses criminal system as instrument of managing social insecurity. The USA has declared »war against drugs« with zero tolerance, but is trying to enable police and law managment of poverty. Europe has also joined in »the war against drugs«, but has started a fight against those groups of people, who are considered less usefull and dangerous to society as a whole. The rise of private industry has strengthen mass incarceration. Modern function of prisons or rehabilitation and resocialisation has been in the background for some time. Prisons are overcrowded with African-Americans and European "strangers" and cannot fullfill the primary goals. In today`s time prison has become waste dump of dangerous individuals in society.
