Abstract
Slovenija se je v različnih mednarodnih in domačih strateških dokumentih zavezala k sistemski ureditvi osebne asistence. Osebna asistenca se je sicer projektno izvajala že pred sprejetjem Zakona o osebni asistenci, vendar so bila sredstva omejena, pomoči pa niso dobili vsi, ki bi jo potrebovali. S sprejetjem Zakona o osebni asistenci v februarju 2017 je osebna asistenca postala pravica, področje osebne asistence pa se je sistemsko uredilo. Osebna asistenca je sredstvo, ki zagotavlja pomoč uporabniku pri vseh tistih vsakodnevnih opravilih in dejavnostih, katerih uporabnik zaradi vrste in stopnje invalidnosti ne more izvajati sam. Osebna asistenca uporabnikom omogoča, da živijo neodvisno življenje izven institucionalnega varstva, prav tako pa jim omogoča, da so bolj neodvisni od pomoči svojih družinskih članov. Osebna asistenca je dostopna vsem pod enakimi pogoji. Izrecno je določeno, da se premoženje in dohodek osebe pri presoji upravičenosti ne upoštevata. Zakon ima sicer še vedno nekatere pomanjkljivosti, ki jih bo potrebno urediti za boljše in učinkovitejše izvajanje osebne asistence v praksi.

Title:Personal Assistance in Theory and Practice
Abstract:
Slovenia has committed itself to ensure systemic regulation of personal assistance through several international and domestic strategic documents. Personal assistance has been carried out on a project basis even before the adoption of the Personal Assistance Act, but funds were limited and not everyone who needed it received assistance. With the adoption of the Personal Assistance Act in February 2017, personal assistance became a right, and the area of personal assistance was systematically regulated. Personal assistance is a means of providing assistance to the user in all those daily tasks and activities which the user, due to the type and degree of disability, cannot perform on their own. Personal assistance allows users to live an independent life outside of institutional care, and also allows them to be more independent of the help of their family members. Personal assistance is available to all persons under the same conditions, and it is explicitly stated that a person's property and income are not taken into account when assessing eligibility. The Personal Assistance Act still has some shortcomings that will need to be addressed in order to better and more effectively implement personal assistance in practice.
