Abstract
Sodelovanje javnosti v postopkih priprave predpisov je izrednega pomena. Sistematična, dosledna in kakovostna vključenost javnosti v pripravo predpisov pripomore h kakovostnejši zakonodaji. Namen magistrskega dela je analizirati sodelovanje splošne javnosti pri pripravi predpisov in raziskati obseg sodelovanja splošne javnosti preko pod-portala eDemokracija. V sklopu slednjega je bil cilj izvedba raziskave, s katero je bilo preverjeno dejansko sodelovanje splošne javnosti v postopku priprave zakonov in podzakonskih predpisov. V raziskavi smo se omejili na upravno, finančno in okoljsko-prostorsko področje v dveletnem obdobju. Prav tako smo naredili primerjavo dveh primerljivih portalov za sodelovanje javnosti v pripravi predpisov, pod-portal eDemokracija s portalom e-Savjetovanja. Rezultati raziskave sodelovanja javnosti kažejo, da se le-ta vključuje v postopke priprave predpisov, pri čemer ni večjih razlik med obema analiziranima letoma in med analiziranimi področji. Glede na parametre raziskave njenih rezultatov sicer ne moremo posplošiti na ostala področja, dajemo pa podlago za nadaljnje raziskave v tej smeri. Primerjava portalov je pokazala nekaj dobrih rešitev, ki bi jih pod-portal eDemokracija lahko vpeljal in s tem povečal zanimanje javnosti za vključevanje v nastajanje zakonodaje. Rezultati raziskave prispevajo nova spoznanja tako pripravljavcem predpisov kot splošni javnosti. Prvim so na voljo podatki o dejanskem sodelovanju javnosti pri pripravi predpisov in rešitve v primerjani državi, drugim pa predvsem prikaz odprtosti ter transparentnosti postopka oblikovanja predpisov in s tem možnosti sodelovanja.

Title:Public participation in law-making - case of eDemokracija sub-portal
Abstract:
Public participation is of a crucial importance when preparing regulations. Systematic, consistent and quality inclusion of the public in the regulation preparation contributes to more quality legislation. Purpose of the master thesis is to analyse the cooperation of the general public at regulation preparation and to research the extent of cooperation of it through the eDemokracija portal. One of the goals was the research which tested actual cooperation of general public in the process of drafting laws and bylaws. The research was limited to administrative, financial and environmental/spatial areas in the 2 year period. A comparison of two comparable portals for public cooperation with respect to legislation was also made; sub-portal eDemokracija and eSavjetovanja. The results of the research show that the public is taking part in the processes of preparation of legislation and there is no major differences between both analysed years and areas. Looking at the parameters of the research we cannot apply the results to other areas, but we can lay foundations for further research. Comparison of both portals showed some good solutions which could be introduced to eDemokracija sub-portal which could facilitate more involvement of general public. Results of this research contribute new findings for drafters of new regulation as well as to general public. Drafters can use data of the actual cooperation of public as well as the solutions available in the other country compared and the general public can see through this data the level of openness and transparency with respect to creation of regulation and by this their possibilities for further involvement.
