Abstract
Digitalne tehnologije se v zadnjih letih razvijajo z veliko hitrostjo. Z vse večjo digitalizacijo se kibernetske grožnje in z njimi povezana kriminalna dejanja pojavljajo vse pogosteje in so čedalje bolj izpopolnjena. Prav zato je eden izmed temeljnih ciljev EU izboljšati zmogljivosti odzivanja na področju kibernetske varnosti, kot tudi zaščito celovitosti, varnosti in odpornosti digitalne infrastrukture in storitev, pri čemer imajo pomembno vlogo tudi predpisi. Glede na to, da je zagotavljanje kibernetske varnosti v zadnjem času vse aktualnejša tema, sem se odločila analizirati, v kolikšni meri se izvajajo aktivnosti na tem področju v EU in predvsem v Sloveniji. Tako glede sprejemanja predpisov kot tudi izvajanja drugih vzporednih ukrepov. Raziskava je bila izvedena s pomočjo obstoječe literature in zakonodaje, analize statističnih podatkov in intervjujev. V raziskavi sta bili dve hipotezi potrjeni v celoti in ena delno. Ugotovljeno je bilo, da se zaradi digitalizacije in naraščanja kibernetskih napadov kaže potreba po pravnem urejanju kibernetske varnosti. Hkrati je treba izvajati tudi druge vzporedne ukrepe, predvsem na operativni in strateški ravni. Slovenska pravna ureditev je v večini primerov skladna s predpisi EU, prihaja pa do zamud pri sprejemanju nacionalne zakonodaje, kar povzroči tudi določena neskladja Na podlagi raziskave je bilo ugotovljeno, da zagotavljanje kibernetske varnosti na nacionalni ravni kljub sprejetju številnih ukrepov v zadnjem obdobju ni na dovolj visoki ravni. Zato bo treba temu področju nameniti več pozornosti kot do sedaj.

Title:ANALYSIS OF LEGAL REGULATION OF CYBER SECURITY IN SLOVENIA AND THE EU
Abstract:
Digital technologies have been developing at a rapid pace in recent years. With increasing digitalization, cyber threats and related criminal acts are becoming more common and more sophisticated. That is why one of the EU's fundamental objectives is to improve its cyber security response capacity, as well as protection of the integrity, security and resilience of digital infrastructure and services, where regulation also have an important role. Given that, providing cyber security has recently become increasingly relevant issue, I decided to analyse the extent to which activities in this area are being carried out in the EU, and especially in Slovenia. Both in terms adopting regulations, as well as implementing other parallel measures. The survey was conducted using existing literature and legislations, statistical data analysis, and conducting interviews. In the study, two hypotheses were fully confirmed and one partially. It has been found, that the digitalization and the rise of the cyber-attacks have shown the need for legal regulation of cyber security. At the same time, other parallel measures need to be implemented, especially at the operational and strategic level. Slovenian legislation is in most cases consistent with EU regulations, but there are some delays in adopting of national legislation, which leads to certain inconsistencies. Based on research, it was concluded that the provision of cyber security at the national level, despite the adoption of a number of measures in the recent period, is not at a sufficiently high level. Therefore, more attention will need to be dedicated to this area, than before.
