Abstract
Država s socialno politiko organizira sisteme socialne varnosti, ki vplivajo na socialni položaj državljanov. Leta 2012 sta bila v Sloveniji sprejeta dva nova zakona, in sicer Zakon o uveljavljanju pravic iz javnih sredstev in Zakon o socialno varstvenih prejemkih, ki sta na področje socialne varnosti prinesla veliko sprememb. Osnovni namen diplomskega dela je s pomočjo raziskave ugotoviti, kako sta se socialna prejemka, denarna socialna pomoč in varstveni dodatek s sprejetjem nove socialne zakonodaje, spremenila, kako se je spreminjalo število upravičencev in višina prejemkov. Poleg tega želimo predstaviti pozitivne in negativne posledice sprejetja zakonodaje ter zakonodajne predloge, ki so nastali kasneje. Kot glavni raziskovalni metodi v diplomskem delu smo uporabili analitično in komparativno metodo. Z raziskavo smo ugotovili, da je nova socialna zakonodaja prinesla bolj enostaven sistem za vlagatelje, kasneje tudi za strokovne delavce. Postala je pravičnejša, odpravila je kopičenje pravic, uveljavila preglednejše materialno in premoženjsko stanje vlagatelja in zmanjšala možnost zlorab. Posledično je bilo prejemnikov denarne socialne pomoči in predvsem prejemnikov varstvenega dodatka manj, vendar so dobili višje izplačilo. Najslabši vpliv so občutile enostarševske in velike družine pri uveljavljanju denarne socialne pomoči in upravičenci do varstvenega dodatka. Z izboljšano zakonodajo se krog upravičencev širi, prejemki se višajo. Predstavljeni rezultati raziskave so trenutni, saj se socialna zakonodaja vsako leto spreminja oziroma dopolnjuje.

Title:THE ANALYSIS OF EXERCISING RIGHTS ARISING FROM PUBLIC FUNDS IN THE CASE OF SOCIAL ASSISTANCE BENEFITS IN CASH AND SUPPLEMENTARY BENEFIT
Abstract:
The state organizes systems of social security by its social politics. The systems influence the social status of the citizens. In 2012, two new laws were adopted in Slovenia, i.e. the Exercise of Rights to Public Funds Act and the Social Assistance Payments Act. They enabled a lot of changes in the field of social security. The basic purpose of the bachelor’s thesis is to ascertain through research how social benefits, social assistance benefits in cash and supplementary benefit, changed by the adoption of the new legislation and how the number of the beneficiaries and the height of benefits changed. Additionally, we wish to present positive and negative consequences of the adoption of the legislation and the legislative proposals which were tabled later. We used the analytical method and the comparative method as the main research methods in the bachelor’s thesis. We ascertained with the research that the new social legislation enabled a simpler system for the applicants and, later, also for the case managers. It has become juster. It has eliminated the accumulation of rights. It implemented more transparent material conditions and assets of the applicant and diminished opportunities for abusive practice. Consequently, there were fewer beneficiaries of social assistance benefits in cash and, mostly, the beneficiaries of supplementary benefit. However, they received a higher amount of benefits. Single-parent and large families experienced the worst influence in exercising social assistance benefits in cash, as well as the beneficiaries to supplementary benefit. The circle of beneficiaries spreads and the benefits increase with the improved legislation. The presented results of the research are momentary because social legislation changes and is supplemented every year.
