Many people all over the world leave for work in the morning as if they were going to battle. Due to psychic violence, they hate the job and work they once loved, gradually become desperate and depressed and often become seriously ill. Some quit, others insist and seek for solutions from a vicious cycle of psychological harassment.
Labor protection of rights is ensured in our labor, civil and criminal law. The problem that I will highlight in my master's thesis relates to the question of whether the criminal protection of individuals within the employment relationship is appropriate and effective, and what are the aims of establishing criminal protection, despite of existing civil protection of workers in employment relationships. The master's thesis will describe the criminal law possibilities of exercising the rights of victims of harassment in the workplace and the interplay of legal norms of different legal branches, especially labor and criminal law.
The main purpose of the master's thesis is to present the basic institutes and rights governed by the Labor Relations Act (hereinafter ZDR-1), the Criminal Code (hereinafter KZ-1), and the Law on Civil Servants (hereinafter ZJU) in connection with the appearance of harassment at work.
By comparing and analyzing the relevant legal systems in Slovenia and Europe, I would like to point out the possible shortcomings of Slovenian case law, criminal law and labor law in the field of the crime of harassment in the workplace.
