Abstract
Magistrsko diplomsko delo je posvečeno obravnavi občinskega podrobnega prostorskega načrta (v nadaljevanju: OPPN), ki ga uvrščamo v kategorijo splošnih pravnih aktov. Pristojnost za sprejem OPPN je podeljena občini, katere vodilo pri sprejemu je trajnostni razvoj in z njim povezano smotrno izkoriščanje zemljišč. OPPN predstavlja najpodrobnejši občinski prostorski akt občine, s katerim se podrobneje načrtuje kompleksnejše prostorske ureditve. V prvem delu magistrskega diplomskega dela je na splošno predstavljeno prostorsko urejanje in pomembnejši instituti prostorskega načrtovanja. Za lažje razumevanje bistva so natančneje razčlenjeni prostorski izvedbeni akti, med katere uvrščamo tudi OPPN. Poudariti velja tudi načelo hierarhije, v skladu s katerim morajo prostorski izvedbeni akti temeljiti na izhodiščih prostorskih strateških aktov. V osrednjem delu je podrobneje predstavljena natančna zakonska ureditev vsebine in postopka sprejema OPPN. Pri pripravi slednjega je potrebno upoštevati namen urejanja, pri čemer je pripravljavec plana vezan na ureditev določeno z OPN, lahko pa sprejem OPPN predlaga tudi zasebni investitor. Vsebina OPPN se nanaša predvsem na urejanje izvedbene regulacije prostora, pri čemer se z OPPN lahko spreminjajo tudi prostorski izvedbeni pogoji in namenska raba prostora. Postopek sprejema OPPN je močno reguliran, saj gre za usklajevanje več različnih interesov, pri katerih je potrebno najti uravnoteženo rešitev. V ta namen je predvidena tudi vključitev javnosti, ki ji mora biti zagotovljeno učinkovito sodelovanje. Postopek sprejema OPPN je razdeljen v več vsebinsko različnih faz. Najprej občina na podlagi splošnih smernic nosilcev urejanja prostora pripravi izhodišča in sklep o pripravi OPPN. Sledi sodelovanje z nosilci urejanja prostora in priprava osnutka OPPN ter njegova javna objava. Po ponovni uskladitvi predlogov javnosti občina pripravi predlog OPPN, kateremu v grobem sledita samo še potrditev in sprejem OPPN s strani občinskega sveta. Zaradi varstva okolje pa se lahko postopku sprejema OPPN pridruži še postopek celovite presoje vplivov na okolje, ki poteka vzporedno. Nadaljevanje dela je namenjeno predstavitvi nove ureditve sodnega varstva zoper prostorske izvedbene akte in obravnavi različnih institutov države za nadzor lokalnih oblasti pri izvajanju prostorskega načrtovanja. Za konec je predstavljena še možnost občanov za udeležbo pri pripravi prostorskih aktov v okviru neposredne demokracije.

Title:MDSP – Municipal detailed spatial plan
Abstract:
The following master's thesis deals with consideration of municipal detailed spatial plan (in the continuation referred to as MDSP), which is classified in the category of general legal acts. The competence to adopt MDSP is allocated to the municipality, which prioritizes sustainable development and the related land exploitation in a rational manner. MDSP represents the most detailed spatial act of the municipality, with which more detailed and more complex spatial arrangements are planned. Spatial arrangement and more relevant institutes of spatial planning are presented in the first part of this master's thesis. Spatial development acts, which MDSP is also a part of, are more accurately specified so as to understand the topic more easily. The hierarchy principle should also be pointed out, because according to this principle detailed spatial development acts must be based on the grounds of strategic spatial acts. In the central part the accurate legal regulation of content and the regulation of adoption procedure of MDSP are presented in more detail. During the preparation of MDSP the purpose of regulation must be taken into account, while the plan organizer is bound to follow the regulation, specified with municipal spatial act. However, the adoption of MDSP may also be proposed by a private investor. The content of MDSP refers primarily to arranging development spatial regulations, during which spatial implementation conditions and the planned spatial use might change together with MDSP. The procedure of adopting MDSP is heavily regulated, as it involves coordination of several fields of interest, which require a balanced solution. Therefore, the inclusion of public is also predicted and the public has to be able to cooperate effectively. The MDSP adoption procedure is divided into several different stages in terms of content. First off, the municipality prepares the starting points and conclusion about MDSP preparation according to general guidelines of the spatial-planning authorities. The next stage requires cooperation with spatial-planning authorities and the preparation of MDSP draft, which is further followed by public release. Upon re-regulating public proposals MDSP proposal is prepared by the municipality, which is then roughly followed by the municipal council confirming and adopting MDSP. Due to environmental protection the MDSP adoption procedure may run alongside a strategic environmental assessment. Follow-up work is intended to present new regulation of judicial protection against detailed spatial development acts and the consideration of various institutes of the state in order to supervise local authorities during the implementation of spatial planning. Finally, the possibility for municipality residents to participate in the preparation of spatial acts within the scope of direct democracy is also presented.
