Abstract
Že od zgodnjih dni filmskega ustvarjanja pravni elementi vplivajo na filmsko industrijo. Naš vsakdan zaznamuje vedno bolj digitalizirano in globalizirano okolje, kjer intelektualna lastnina pridobiva vedno pomembnejše mesto. Zaradi neoprijemljive narave intelektualne lastnine je ključno razumeti pravne okvire, norme in koncepte, s katerimi lahko umetniki, ustvarjalci ali producenti zaščitijo svoja avtorska dela. Nove tehnologije nenehno spreminjajo kreativne in poslovne strategije v filmski industriji. Sočasno in nenehno se prav tako dopolnjujejo, gradijo in oblikujejo avtorske doktrine. V nobeni drugi kreativni industriji ni takšnega prepleta umetnosti, tehnologije in pravnih zadev. Za filmskim procesom stoji ogromna množica ljudi, ki s svojim ustvarjalnim prispevkom, znanjem in know-how omogočajo nastanek filma. Zaradi kompleksnosti procesa v ozadju deluje mnogo odvetnikov in zavarovalnih zastopnikov. Rezultat vse bolj digitaliziranega in medsebojno odvisnega trga je sprejetje mednarodnih dokumentov, ki prispevajo k harmonizaciji in boljši zaščiti za imetnike avtorskih pravic in njihovih del. Poznavanje avtorskega prava v Sloveniji in ZDA lahko pripomore k bistvenemu razumevanju razlik. Drugačni temelji avtorskega prava prav tako različno vplivajo na pomen filma in filmske industrije.

Title:Intellectual property as a key factor for viability and development of the film industry
Abstract:
Since the early days of filmmaking, legal instruments have influenced the film industry. Our everyday lives are under impact by an increasingly digitalized and globalized environment, where intellectual property rights gained an important place. Due to the intangible nature of the intellectual property, it is crucial for artists, creators, and producers to understand the legal frameworks, concepts, and norms, which can protect their copyrighted works. In the film industry, new technologies are constantly changing creative processes and business strategies. As well, also the author's doctrine is being constantly complimented, built, and reshaped. In any other creative industry, there is not such an intertwining of art, technology, and legal aspects. Behind every film process, many people invest their creative work, know-how, and knowledge. As a result of this complexity, which is present in every stage, many lawyers and insurance agents work behind the scenes. An increasingly digitalized and mutual market lead to the ratification of many international documents, with a goal for better harmonization and protection for the right owners and their works. Understanding copyright in Slovenia and copyright in the United States of America can significantly help to understand major differences. Different foundations of copyright systems also have a different impact on the significance of film and film industry.
