Abstract

Title:Judicial protection against spatial executive acts
Abstract:
With the new spatial legislation, a new Spatial Planning Act (ZUreP-2) was adopted, which brought some changes to the field of land use planning. The judicial protection against spatial implementing acts is certainly one of the more significant changes. From the effective date of the new regulation by statute, an individual can institute a proceeding of an administrative dispute before the Administrative Court of the Republic of Slovenia for the assessment of the legality of a spatial executive act. The ZUreP-2 specifies, which persons can bring an administrative dispute and under what conditions.
