PRIMERJAVA ZAČASNEGA IN OBČASNEGA DELA ŠTUDENTOV IN UPOKOJENCEV V SLOVENIJI

Institut začasnega in občasnega dela je v Sloveniji namenjen le določenim skupinam upravičencev, tj. dijakom, študentom in upokojencem. Medtem ko je začasno in občasno delo dijakov in študentov že več desetletij prisotno na trgu dela v Sloveniji, je bilo začasno in občasno delo upokojencev urejeno šele v letu 2013. Obe obliki dela predstavljata nestandardno, atipično obliko zaposlitve, ki je najbolj fleksibilna in hkrati predstavlja tudi konkurenco redno zaposlenim delavcem na trgu dela. Kljub poizkusom enotne ureditve začasnega in občasnega dela kot oblike malega dela v preteklosti je pravna ureditev začasnega in občasnega dela dijakov in študentov ter upokojencev še vedno predmet več pravnih predpisov, ki se med sabo prepletajo in različno urejajo institut začasnega in občasnega dela. To pa pomeni tudi večjo možnost za zlorabo instituta začasnega in občasnega dela, ki lahko vodi v segmentacijo na trgu dela. V diplomskem delu poskusim z analizo pravnih predpisov, ki urejajo začasno in občasno delo dijakov in študentov ter upokojencev, in druge strokovne literature ugotoviti, katere so prednosti, slabosti ter razlike med začasnim in občasnim delom dijakov in študentov ter začasnim in občasnim upokojencev in ali so razlike v obravnavi iste oblike dela smiselne in pravno utemeljene ter ali bi bilo smiselno v prihodnosti urediti pravne predpise na način, ki bi bil enakovreden tako za dijake in študente kot tudi za upokojence.

• Title: COMPARISON OF TEMPORARY AND OCCASIONAL WORK OF STUDENTS AND PENSIONERS IN SLOVENIA

Abstract

The institute of temporary and occasional work is dedicated to certain groups of beneficiaries in Slovenia, i.e. pupils, students and pensioners. While temporary and occasional work of pupils and students has been present in the labour market in Slovenia for decades, regulation of temporary and occasional work of pensioners was not instigated until 2013. Both forms of work represent a non-standard, atypical form of employment, which is the most flexible and also represents competition to full-time workers in the labour market. Despite the attempts to unify the regime of temporary and occasional work as a form of small work in the past, the legal regulation for the temporary and occasional work of pupils, students and pensioners is still subject to various legal rules that intersect and differentiate among the institute of temporary and occasional work. The latter represents a greater possibility for abuse of the institute of temporary and occasional work, which can also lead to segmentation in the labour market. In my thesis, I will try to analyse the legal regulations governing temporary and occasional work of students and pensioners and other professional literature to find out what are the advantages, disadvantages and differences between temporary and occasional work of students and temporary and temporary pensioners, and in particular whether differences in the treatment of the same form of work are reasonable and legally justified and whether it would be meaningful in the future to regulate legal regulations in a way that would be equivalent to both pupils and students as well as pensioners.
