The theme of the thesis is the question of expansion of legality of the use of (physical) force in Slovenia. Some philosophical views on the relation between force and law are reviewed, followed by a discussion on the close connection of state with the use of force, while questioning the legitimacy of states in general. The conflict between personal liberty and the use of force is analysed to some extent followed by a more rigorous review and analysis of constitutional and statutory provisions that regard the use of force. Briefly, the question on the use of force in horizontal legal relationships is discussed, especially regarding the legal institutes of self-help and self-defence. The authorizations of the use of force, given to certain state and local authorities and some private security organisations, are thoroughly reviewed and studied. Selected legal provisions and legal institutes are historically compared, especially those regarding the police and municipal wardenship. The purpose of the comparison is to identify the movements of the field of legality of the use of force. Select Slovenian cases in front of the ECHR regarding the use of force are analysed.
