ANALIZA STANJA NADZORSTVENIH POSTOPKOV PRED INŠPEKTORATOM REPUBLIKE SLOVENIJE ZA DELO

Abstract
Inšpektorat RS za delo je pomemben organ, katerega poslanstvo je izvajanje učinkovitega nadzora nad spoštovanjem zakonodaje s področij delovnih razmerij, varnosti in zdravja pri delu ter socialnega varstva. Namen diplomskega dela je ugotoviti, katero izmed vseh treh področij je najbolj problematično z vidika ugotovljenih kršitev, katere so te kršitve in ali se število teh kršitev z leti zmanjšuje ali povečuje. V diplomskem delu uporabimo kvantitativno metodo analize, in sicer z analizo letnih poročil Inšpektorata RS za delo med letoma 2016 in 2018 pridemo do statističnih podatkov v različnih kategorijah. Poleg splošnih podatkov inšpektorata podrobno pregledamo tudi statistične podatke s področja varnosti in zdravja pri delu, saj smo prav to področje že pred začetkom pisanja diplomskega dela prepoznali kot področje, na katerem se dogaja največ nepravilnosti. Za boljšo predstavo poteka inšpekcijskih nadzorov v praktičnem delu opravimo še analizo petih primerov inšpekcijskega nadzora, ki ga je opravil Inšpektorat RS za delo. Rezultati analize potrdijo, da se največ nepravilnosti ugotavlja na področju varnosti in zdravja pri delu, presenetljivo pa je dejstvo, da je največ inšpekcijskih pregledov letno opravljenih na področju delovnih razmerij. Analiza letnih poročil je pokazala, da Inšpektorat RS za delo svoje delo opravlja dobro v okviru svojih zmožnosti. Ovire za še večjo učinkovitost namreč predstavljajo majhno število zaposlenih inšpektorjev, premalo finančnih sredstev, namenjenih izpopolnjevanju inšpektorata, in zapleteni primeri, ki vzamejo veliko časa za reševanje in se lahko vlečejo tudi po več let.

Title:ANALYSIS OF SUPERVISORY PROCEDURES BEFORE THE LABOUR INSPECTORATE OF THE REPUBLIC OF SLOVENIA
Abstract:
The Labour inspectorate of the Republic of Slovenia is an important administrative body, whose main purpose is the supervision of compliance with Employment Relations legislation, Health and Safety at Work legislation as well as Social Security legislation. The purpose of this dissertation was to determine which of the three areas is most problematic in terms of the established violations, what these violations are and whether the number of such violations decreases or increases over the years. The data for this dissertation was collected by analysing the Labour inspectorate's annual reports from 2016 to 2018, which include statistical data from different categories. In addition to reviewing the general information on the Labour inspectorate, this dissertation further examined the statistical data from the field of Health and Safety at Work, as it has been identified as the area with most irregularities. To further understand how inspections are carried out, this dissertation analysed five examples of inspections that were sent by the Labour inspectorate. The analysis results showed that most irregularities are indeed identified in the area of Health and Safety at Work, however most inspections are annually carried out in the field of Employment Relations. Based on the analysed figures from the Labour inspectorate's annual reports, this dissertation concludes that the Labour inspectorate of the Republic of Slovenia performs its job well within the scope of its capabilities. The issues with increasing the inspectorate's productivity occur as a consequence of a small number of employed inspectors, insufficient financial resources for any improvements and complex cases, which take a long time to be resolved and can continue for several years.
