The office of President of the Republic of Slovenia is the highest and most respected function in the current regulation of state power. Despite the prestige of the office and direct election in general elections, it mostly has only a representative role, which stems from Article 102 of the Constitution of the Republic of Slovenia. The same article conferred on the President of the Republic the role of Supreme comander of the defense forces. This puts it directly in the defense system, which, in addition to the internal security system and the system of protection against natural and other disasters, forms the spine of the national security system of the Republic of Slovenia. The problem arises because the Defense Act and other legal acts do not follow the constitutional provision and remove the function of the supreme comander from the command and control system. This results in disordered relations between the authorities, especially during wartime. The diploma thesis presents certain alternatives to the current arrangements, which were formulated by Slovenian experts. In addition to his role as supreme commander, the President of the republic has a reserve legislative role in the events of an emergency or war, when the national assembly cannot meet. The thesis notes that the President of the Republic is positioned high in the national security system, but only in protocol.
