The attempt to commit a felony is an institute of the general part of the Slovenian Criminal Code CC-
1. It is included in chapter three, within the general provisions on a felony. The attempt is also intrinsic
to an unsuitable attempt and is directly related to voluntary withdrawal.
The attempt is not punishable in principle, except for crimes for which the law stipulates a minimum
term of imprisonment of at least three years or for crimes where it explicitly demands punishment for
an attempt. The punishment for the attempt is the same as for the completed crime, but the offender
can be punished more leniently. For an inappropriate attempt and in case of voluntary withdrawal the
court may order a discharge.
The purpose of criminalizing the attempt to commit a felony is to protect the most important goods of
the individual and society. Although at stage of the attempt these have not been harmed yet it is
important for the functioning of social system that the perpetrators are punished.
