Abstract
Urejanje delovnega časa je že desetletja v ospredju političnih, ekonomskih in socialnih razprav tako na mednarodni in evropski ravni kot tudi na nacionalni ravni, zaradi česar je bilo potrebno v zadnjih desetletjih organizacijo dela, vključno z delovnim časom, prilagoditi potrebam globalizacije, globalne konkurence in razvoju informacijske tehnologije. Kot odziv na te spremembe so se začele pojavljati fleksibilne oblike razporejanja delovnega časa posameznega delavca, hkrati pa so se zaradi teženj delodajalcev, da delo prilagodijo naraščajočemu storitvenemu sektorju, pojavile nove oblike dela, v okviru katerih delavec delo opravlja s pomočjo informacijske tehnologije ali pa se prek informacijske tehnologije odzove na potrebe delodajalca po delu. To pa ni edini način, na katerega je informacijska tehnologija vplivala na delovni čas. Delavci, ki delo opravljajo v tradicionalnem delovnem razmerju, so s pomočjo informacijske tehnologije postali dosegljivi kjerkoli in kadarkoli. S tem se obseg dela posameznega delavca povečuje, kar ima posledice tudi na področju varnosti in zdravja pri delu. Uporaba informacijske tehnologije glede na dan zakonski okvir prinaša nove izzive v zvezi z vštevanjem dela v delovni čas in opredelitve delovnega časa tako z vidika maksimalnega dnevnega in tedenskega delovnega časa kot tudi z vidika zagotavljanja minimalnega počitka. Stalna dosegljivost delavcev pa je v številnih evropskih državah že prispevala k razvijanju t.i. pravice do izključitve.

Title:Working hours at times of Information Technology
Abstract:
For decades, working time has been at the forefront of political, economic and social debates both at international and European as well as at national level. Employers had to adapt organization of work, including working time to globalization, global competition and progress on a field of information technologies. In response to these changes flexible forms of working time have emerged. Furthermore, employers’ aspirations to adapt work to the growing service sector have resulted in the emergence of new forms of employment where information technology is broadly used as means of work or to respond to employers’ needs. However, this is not the only way in which information technology affected working time. Workers in a traditional employment relationship have with information technology become accessible anytime and anywhere, which increased their workload and negatively affected occupational health and safety. Given the current legal framework, the use of information technology brings new challenges in defining the scope of work after working hours, especially in determining working time in terms of maximum daily and weekly working time, as well as from the aspect of ensuring minimum rest. Constant availability of workers has already been addressed in a few European countries, which have implemented the right to disconnect into their legislature.
