Abstract
Splošna uredba o varstvu podatkov je 25. 5. 2018 temeljito spremenila načine obdelovanja osebnih podatkov v evropskem prostoru. Podjetja, ki pri svojem delu obdelujejo osebne podatke, so morala njena določila implementirati v svoje načine poslovanja. Med takšne organizacije sodijo tudi podjetja, ki svojim naročnikom nudijo storitve iskanja in izbora kadrov, za katere je v tem delu uporabljeno poimenovanje kadrovsko svetovalna podjetja. Delo skuša identificirati ključne izzive, s katerimi so se podjetja soočala pri implementaciji določil uredbe. Koncept naloge sloni na deduktivni analizi strokovnega gradiva, iz katerega so izluščena bistvena področja, ki bi lahko vplivala na delovanje tovrstnih podjetij, ter več specifičnih izzivov, s katerimi so se najverjetneje soočala v času uvedbe. Izbrana raziskovalna metoda je kvalitativna in zajema polstrukturirana intervjuja z dvema pravnikoma, ki sta kadrovsko svetovalnim podjetjem nudila svetovalne storitve. Identificirani izzivi, s katerimi so se kadrovsko svetovalna podjetja soočala v času uvedbe, so imenovanje pooblaščene osebe za varstvo podatkov, vzpostavitev evidenc o obdelavi osebnih podatkov, redefiniranje pogodbenih razmerij do drugih podjetij, splošna določitev pravne podlage za obdelavo podatkov ter preoblikovanje privolitev, ureditev dokumentacije za interne zaposlene, izpolnjevanje pravic posameznikov v zvezi z obdelavo njihovih osebnih podatkov.

Title:General Data Protection Regulation 2016/679 implementation challenges in HR consulting firms
Abstract:
The General Data Protection Regulation 2016/679 fundamentally changed the ways in which personal data is processed in the EU. All companies processing personal data have had to implement its provisions in their business methods. Impacted organizations include HR consulting firms specializing in search and selection of personnel. In this paper, we try to identify the key challenges such companies faced during the implementation period. The concept of the paper is based on a deductive analysis of scholarly literature from which we tried to identify the key areas impacting the companies’ activities and thus propose several specific challenges the companies most likely faced while implementing GDPR. The selected research method is qualitative and consists of semi-structured interviews conducted with two law practitioners who provided advisory services to such companies. The key identified challenges faced by HR consulting firms include the appointment of data protection officer (DPO), the establishment of processing activities records, revision of contractual relationships in regards to other companies, general determination of the proper lawful basis for data processing including consent form revision, rearrangement of documentation addressing internal employees and the actualization of new data subject rights.
