Abstract
Pridobitev gradbenega dovoljenja je postopek, ki je zapleten in lahko investitorju povzroči kar nekaj preglavic. V diplomski nalogi me je zanimal časovni okvir, ki ga investitor potrebuje za pridobitev gradbenega dovoljenja. Ali je čas pridobitve gradbenega dovoljenja po novem zakonu pri nas primerljiv z avstrijskim ter kakšne so razlike pri samem postopku v obeh državah. Namen dela je prikazati celoten potek, ki je povezan s pridobitvijo gradbenega dovoljenja, z osredotočenostjo na novosti, ki jih je prinesel Gradbeni zakon. Predstavljena je zakonska podlaga, ki je temelj postopka pridobivanja gradbenega dovoljenja, podana pa tudi teoretična analiza poteka pridobivanja gradbenega dovoljenja v Sloveniji in avstrijski zvezni deželi Koroški. Novosti, ki jih je prinesel novi zakon, bodo primerjane z avstrijskim, podala pa bom tudi analizo razlik med njima. Pri izdelavi diplomskega dela sem uporabila zgodovinsko metodo, metodo deskripcije, metodo kompilacije in primerjalno metodo. Delo temelji na upravno-pravni teoretični podlagi. Ugotovitve v nalogi so, da ima Avstrija v primerjavi s Slovenijo daljše roke. Po prebiranju zakonov sem ugotovila, da so koroški zakoni manj zahtevni in da niso tako obsežni kot slovenski. Vseeno pa je sam postopek pridobitve gradbenega dovoljenja tako v Avstriji kot v Sloveniji za preprostega človeka prezahteven. Nov zakon prinaša zmedo med uslužbence, saj še ni prišlo do uskladitev vseh predpisov, ker so nekateri še v teku pripravljanja.

Title:OBTAINING A BUILDING PERMIT – A COMPARATIVE LEGAL ANALYSIS OF REGULATION IN SLOVENIA AND AUSTRIA
Abstract:
Obtaining a building permit is a complicated process and can cause the investor great inconvenience. In our thesis, we discuss the time limits that are necessary for the investor to get a building permit, whether the time limit, set in the new Slovene Building Act, is comparable to the time limit set in the Austrian legislation and what main differences can be observed in the building permit application process in Slovenia and in Austria. The aim of our thesis is to explain the building permit application process, in which we focus on the novelties, introduced in the new Slovene Building Act. In the thesis, we present the legal basis, which is the foundation for obtaining a building permit, and introduce a theoretical analysis of the building permit application process in Slovenia and in the Austrian state of Carinthia. We compare the novelties that were introduced in the new Slovene Building Act with the Austrian legislation and present an analysis of the key differences between the two processes. While working on our thesis, we relied on the historical method, description method, compilation technique and the comparison technique. Our thesis is based on the administrative and legal theoretical part. In our thesis we show that, compared to Slovenia, Austria has longer time limits. In researching the legislation, we established that the Austrian legislation is easier to understand and not as extensive as the one in Slovenia, nevertheless, the entire process of obtaining a building permit is complicated in Slovenia as well as in Austria. The new Building Act causes confusion among employees, as the changes have not been coordinated and adjusted in all areas of legislation, and some parts of the legislation are still in the preparation phase.
