Abstract
Otroci v skladu z mednarodnim in nacionalnim pravom uživajo posebno varstvo. Potrebno jih je dojemati kot enakopravne subjekte v različnih družinsko pravnih postopkih. Zato se poudarja, da je pravica do stikov primarno otrokova pravica oziroma da gre za otrokove stike. Otrok ima kadarkoli, ko je ločen od enega ali obeh staršev pravico do vzdrževanja stikov na različne načine, v skladu z osnovnim vodilom otrokovih koristi. Otroku je zagotovljena tudi pravica do stikov z drugimi osebami, če je z njimi čustveno povezan in kadar so takšni stiki otroku v korist. Rejništvo je ena izmed situacij, ko država poskrbi za nadomestno skrb za otroka, kadar začasno ne more živeti v svoji družini. V tem obdobju so ravno stiki tisti pomembni faktor, ki otroka ohranijo v določeni povezavi s starši. O izvrševanju stikov se poskušajo dogovoriti sporazumno v individualni projektni skupini, če so stiki otroku v korist. Pomembna je tudi dolžnost rejnika k spodbujanju stikov in pripravo otroka nanje. Otrok ima tudi pravico izraziti svoje mnenje, ki se bo upoštevalo v primeru, da je to v njegovo korist. Pristojnost odločanja glede stikov ima sodišče, ki lahko stike tudi omeji ali odvzame, kadar bi prišlo do ogrožanja otroka. Gre za hud poseg v pravico do stikov starša in predvsem otroka, zato je potrebno upoštevati načelo sorazmernega posega. Možni so tudi stiki pod nadzorom, kadar bi bili potrebni zaradi ogroženosti otroka ali kadar starš in otrok ponovno vzpostavljata odnos zaradi daljše časovne nepovezanosti.

Title:Child's contacts in foster care
Abstract:
Children have in accordance to international and national law special protection. We need to accept them as equal subjects in every family law procedures. It is therefore emphasized that the right to contact is the primary right of the child, that is why we speak about child's contacts. Child has whenever he is separate from one or both parents, right to personal relations and direct contact with both parents on a regular basis, in accordance to basic guide child's best interests. Child has also right to contact with other persons, if they are emotionally connected and when the contacts are in child's best interests. Foster care is one of the situations where the state provides for alternative care for a child when he temporarily can not live in his family. During this period, contacts are the important factor that keeps the child in a certain relationship with their parents. About execution of contacts they try to agree on it in individual project group, if the contacts are in child's best interests. Also important duty of foster parent is to encourage contacts and to prepare child for them. The child also has the right to express his opinion about the situation, which will be taken into account if this is in child's best interests. Jurisdiction about contacts has the court, which can contacts also restricted or withdrawn, when a child is threathened. It is a big intervention in right to contacts of parents and especially child, which is why we need to take care of the principle of proportional intervention. It is possible contacts under the control, when they are necessary because of threats childs or when the parent and child again try to establish relationship because of long time disconnection.
