Analiza pogodbenih pogojev v gradbenih pogodbah pri javnih naročilih : diplomska naloga

Skozi čas se je gradbena pogodba precej razvila. V preteklosti je gradbeno pogodbo oziroma dogovor za gradnjo predstavljal le stisk roke obeh strank in poštena beseda. V današnjem času pa je gradbena pogodba veliko bolj kompleksnejša in vsebuje ogromno pravne podlage in pogodbenih pogojev katerim je treba ugoditi, da je pogodba sploh veljavna. V svoji nalogi sem najprej predstavil gradbeno pogodbo kot pojem. Predstavil sem smernice katere se največkrat uporabljajo pri sestavljanju gradbene pogodbe. Prav tako sem opredelil kako naj bi približno zgledala gradbena pogodba oziroma vsebina le-te. Sledila je analiza gradbenih pogodb za leto 2017. V tem delu naloge sem raziskoval podobnosti in razlike med pogodbami ter odgovor na vprašanje koliko se pogodbe ujemajo z vzorcem gradbene pogodbe pripravljenim na GZS.

• Title: Analysis of contract conditions in construction contracts in public procurement : graduation thesis

Abstract

Through time the construction contract evolved massively. In the past it was enough to have a verbal agreement and handshake, which presented today's construction contract. Nowadays is construction contract a lot more complicated and involves a lot of legal basis and contract conditions, which have to be met to make the contract valid. Firstly, I have presented construction contract as concept. The guidelines which are frequently used to assemble the construction contract were also presented. It was also presented how construction contract or the content of construction contract should look like. I did the analysis of construction contracts for year 2017. In these part of graduation thesis I looked for differences and similarities between the contracts and an answer for the question how the contracts match the sample of construction contract made by GZS.
