Every individual is ascribing different meaning and importance to human rights and fundamental freedoms. Nevertheless, this does not change their general meanings. Human rights and fundamental freedoms are the foundation of every adequate national and international regulations that is protecting an individual in relationship towards authority of the state. Equal rights belong to all, regardless of circumstances in which individuals differ from each other. The dissertation presents the position of the Ombudsman of the Republic of Slovenia in the field of preventing of human rights violations in administrative procedure. In addition, it analyses violations in administrative procedures in field of foreigners and citizenship in administrative matters and cohesive actions that the ombudsman dealt with in annual reports from 2014 to 2017. Throughout the dissertation it is discussed whether human rights violations are increasing in the field of foreigners and citizenship or they are reducing; if these violations are similar, and what influence has the work of the Ombudsman of the Republic of Slovenia on these changes. Based on the analysis in the dissertation it has been found out that conditions in field of foreigners and citizenship aren’t improving, as violations are alike, which resembles in violations of administrative procedure and principles of good management. Furthermore, it has been found out that the scope of received initiatives that those whose rights have been violated have addressed on the Ombudsman of the Republic of Slovenia is not decreasing, but has greatly increased in the field of foreigners and citizenship. The content of this dissertation can present a base for further research of flaws in the procedures of administrative-internal matters and a base for finding solutions in preventing of these.
