Abstract
Mobilnost predstavlja naš vsakdan, ki si ga brez motornega vozila ne znamo predstavljati. Vsako vozilo, ki ga lastnik želi uporabljati v javnem prometu, mora imeti veljavno prometno dovoljenje. Za izdajo dovoljenja področni zakoni določajo posebne pogoje. Lastnik vozila mora opraviti tehnični pregled v zakonskih rokih, imeti mora sklenjeno osnovno zavarovanje vozila in opraviti postopek registracije vozila ter pridobiti veljavno prometno dovoljenje. Ta zapleten in velikokrat nerazumljiv postopek sem predstavila v diplomskem delu. Na osnovi analize Zakona o splošnem upravnem postopku, Zakona o motornih vozilih in Pravilnika o registraciji motornih in priklopnih vozil ter drugih zakonskih podlag sem v praktičnem delu teorijo povezala s prakso. Cilj dela je bil preveriti ali zakoni in pravilniki v zadostni meri določajo postopek registracije in zaradi tega v praksi ne prihaja do težav. Tehnični del postopka registracije vozila je predpisan v Zakonu o motornih vozilih, Pravilniku o registraciji motornih in priklopnih vozil in Zakonu o varnosti cestnega prometa. Upravni del postopka pa določa Zakon o splošnem postopku. Vsi omenjeni zakoni in pravilnik točno določajo in predpisujejo postopek, zato v praksi ne prihaja do težav. Upravni postopek lahko vodi le določen organ. Uredba o upravnem poslovanju je določene oziroma posamezne vrste postopkov izvzela iz krajevne pristojnosti. Mednje sodi tudi registracija vozil, zato jo lahko opravimo na kateri koli upravni enoti ali registracijski organizaciji z veljavnim pooblastilom v Republiki Sloveniji.

Title:SUBSIDIARY USE OF GENERAL ADMINISTRATIVE PROCEDURE ACT IN VEHICLE REGISTRATION
Abstract:
Mobility is a part of our everyday life and we cannot imagine it without a motor vehicle. Every vehicle, which the owner wants to use in public transport, must have a valid registration certificate. Sectoral laws have laid down special conditions for issuing licences. The owner of the vehicle must carry out a technical inspection within the specified time limit, conclude basic vehicle insurance, complete the vehicle registration procedure, and obtain a valid registration certificate. I will present this complicated and often incomprehensible procedure in the diploma thesis. Based on an analysis of the General Administrative Procedure Act, the Motor Vehicles Act and the Rules on the Registration of Motor Vehicles and Trailers and other legal bases, I linked the practical part with the theory on key contents and documentation. The goal of the diploma thesis was to check, if the acts and rules determined the procedure of vehicle registration sufficiently, therefore are no grater issues in practise. The technical part of the vehicle registration procedure is stated in the Motor Vehicles Act, the Rules on the Registration of Motor Vehicles and Trailers and the Road Traffic Safety Act. The administrative part of the procedure is determined by the General Administrative Procedure Act. All of the mentioned laws and rules precisely determine and prescribe the procedure, which is why there are no greater issues in practice. The administrative procedure can only be led by an administrative authority laid down by law. The Decree on Administrative Operations has excluded certain types of procedures from territorial jurisdiction. Vehicle registration is one of these types and, as such, can be carried out at any administrative unit or authorised registration organisation throughout the Republic of Slovenia.
