Abstract
Alternative sodnim postopkom predstavljajo svojevrsten prispevek k razreševanju konfliktov na civilnopravnem področju, ki so s prilagoditvijo posebnostim sistema prešli tudi na kazenskopravno področje, za katerega se na prvi pogled zdi, da bi bila njihova uporaba neprimerna. S postopnim razvojem preko pogajanj o priznanju krivde, komisij za resnico in spravo ter mediacije pa je mednarodno kazensko pravo pridobilo nova orodja za zagotovitev pravice. Vztrajanje pri nadaljnem razvoju teh postopkov bi odpravilo marsikatero slabost njihove trenutne uporabe, to pa bi mednarodnemu kazenskemu pravu omogočilo boljše iskanje odgovornosti za povzročena grozodejstva. Naloga predstavlja že uveljavljene načine izvensodnega reševanja kazenskih sporov tako na nacionalni ravni kot v medarodnem kazenskem pravu, načine, ki bi z nadaljnim razvojem ponudile boljše možnosti reševanja konfliktov in možnosti za razvoj novih metod, ki bi lahko prispevale k spravi in pomiritvi prizadete skupnosti, bolj kot to trenutno omogoča klasičen kazenski postopek. Obstoj sistema alternativnega razreševanja sporov bi pripomogel k boju proti nekaznovanosti kot dopolnilo mednarodnim kazenskim sodiščem oziroma njihovo substitucijo, če vzpostavitev pristojnosti teh teles ne bi bila mogoča. Mednarodno kazensko sodišče poleg močne podpore izvensodnih možnosti potrebuje tudi nadaljni razvoj pri delovanju institucije, ki bi dovoljeval pogajanja o priznanju krivde in s tem ustrezno poskrbel tako za pravice obtožencev kot pravice in interese žrtev.

Title:Possibilities of alternative dispute resolution in international criminal law
Abstract:
Alternatives to legal proceedings represent a unique contribution to the resolution of conflicts in the civil law field, which, having adapted to the peculiarities of the system, has also moved to the criminal law area, where at first glance seems to be inappropriate for their use. With the gradual development through plea bargaining, truth and reconciliation commissions, mediation, the international criminal law has acquired new tools to ensure justice. Insisting on the further development of these procedures would eliminate many of the weaknesses of their current use and would allow the international criminal law to better seek responsibility for the atrocities committed. The thesis presents already established methods of out-of-court settlement of criminal cases both at the national level and in the international criminal law, in ways that would offer better opportunities for resolving conflicts and the possibility of developing new methods that could contribute to the reconciliation of the affected community more than this currently enables classic criminal procedure. The existence of an alternative dispute resolution system would help combat impunity as a complement to international criminal courts or their substitution if the establishment of the jurisdiction of these bodies would not be possible. In addition to the strong support of extra-judicial options, the International Criminal Court also needs further development of functioning of the institution, which would allow plea bargaining and thus adequately ensure both, the rights of the defendants and the rights and interests of the victims.
