20.500.12556/RUL-175224 Pravni standard ogroženosti pri uporabi ukrepov za varstvo koristi otroka The legal standard of threat assessment when applying measures to protect the best interests of the child Starši imajo skladno z Družinskim zakonikom pred vsemi drugimi pravico in obveznost varovati pravice in koristi svojega otroka, zaradi česar lahko država izvede ukrepe za varstvo pravic in koristi otroka le takrat, ko starši te svoje pravice in obveznosti ne izvajajo ali je ne izvajajo v korist otroka. Država oz. sodišče lahko v izvajanje starševske pravice poseže le tedaj, če ugotovi, da je otrok ogrožen, otrok pa je ogrožen, če je utrpel ali je zelo verjetno, da bo utrpel škodo in je ta škoda verjetnost posledice storitve ali opustitve staršev ali posledica otrokovih psihosocialnih težav, ki se kažejo kot vedenjske, čustvene, učne ali druge težave v njegovem odraščanju. Gre za pravni standard, ki ga mora pri posameznem ukrepu za varstvo koristi otroka napolniti sodišče. V magistrskem delu je podrobno raziskan in opredeljen pravni standard ogroženosti otroka, in sicer pri posameznem ukrepu za varstvo koristi otroka. Po teoretičnem uvodu o sami ogroženosti otroka in kratkem opisu otrokove koristi, ocene ogroženosti otroka in ogroženosti otroka kot pravnega standarda je na podlagi obširne sodne prakse prikazano, kdaj je sodišče v praksi obrazložilo pravni standard ogroženosti otroka, obenem pa so navedene razlike med samim izkazanim pravnim standardom ogroženosti otroka med posameznimi ukrepi za varstvo koristi otroka. In accordance with the Family Code, parents have the primary right and obligation to protect their child's rights and interests, which is why the state may only implement protective measures when parents fail to exercise these rights and duties, or do not do so in the best interest of the child. The state or the court may only interfere with the exercise of parental rights if it is determined that the child is at risk. A child is considered to be at risk if they are threatened, or there is a high probability that they will suffer, harm, and this harm or risk of harm is a consequence of the actions or omissions of the parents, or results from the child’s psychosocial issues, which manifest as behavioural, emotional, learning, or other difficulties during their upbringing. The respective court must interpret this legal standard in each specific measure to protect the child’s interests. The master's thesis explores and defines in detail the legal standard of threat assessment of a child, specifically in relation to each measure for the protection of the child's interests. After a theoretical introduction on the very concept of threat assessment of a child and a brief description of the child’s best interests, risk assessment, and threat assessment of a child as a legal standard, a broad analysis of case law illustrates when courts have, in practice, explained the legal standard of threat assessment of a child.
