The issuance of residence permits to foreign nationals, particularly citizens of Bosnia and Herzegovina, has increased in recent years. It represents a key measure for facilitating immigration and increasing population growth, while at the same time contributing to State revenue. However, as the number of residence permits rises, applicants encounter various administrative obstacles and ambiguities within the legislation. In 2024, certain administrative barriers were removed, including the elimination of territorial jurisdiction.
The aim of this thesis is to present the administrative procedure for issuing a residence permit, using citizens of Bosnia and Herzegovina as a case example.
The thesis consists of two parts: a theoretical section, which outlines the legal basis of the administrative procedure, and an empirical section, which includes interviews with applicants and identifies the challenges they face.
The findings highlight the justification for the administrative obstacles that have been removed so far and provide an overview of the violation of parties’ rights and fundamental legal principles. The practical value of the thesis lies in the recommendations it offers for improving the user experience in the field of foreign nationals’ administrative procedures, particularly regarding the issuance of residence permits.
