Intellectual property law is a very broad field that covers rights arising from intellectual activity in an industrial, scientific, literary or artistic field. Given the increased use of the protection of these rights in the last few years, it is important that adequate legal enforcement is provided. Without effective legal enforcement, protection of intellectual property rights would not have purpose.
In my master’s thesis, I concentrate primarily on the legal protection of the abovementioned rights. In the beginning the general characteristics of industrial property and copyright and related rights are presented. This is followed by the part about the enforcement in Slovenia and in the international environment, problems related to this area, economic effect and the connection with the field of unfair competition. I also present some of the available case-law dealing with the subject matter. In the end, my paper focuses on the regulation of concrete approaches related to the legal enforcement of intellectual property rights in Slovenia and their adequacy to the law and case law of the European Union.
