In my master's thesis I address the legal status of LGBT + refugees in European Union. Since LGBT+ individuals are still victims of violence and discrimination in many countries of the world, I explore to which extent these individuals are granted international protection in European Union, inter alia, by reviewing Slovenian case law. I assume that main factors during the treatment of LGBT+ asylum seekers are the following: concealment and late disclosure of sexual orientation and / or sexual identity, its criminalisation, defining affiliation to a particular social group as a basis for obtaining international protection, the issue of state protection and the possibility of internal displacement within the country of origin. Consequently, these factors are defined and classified throughout my master's thesis. My initial thesis is confirmed – the legislation of the Common European Asylum System ought to be adapted, in line with the needs of LGBT+ asylum seekers, as one of the particular social groups, which, under the Geneva Convention and the Qualification Directive, should be entitled to apply for International protection in European Union.
